1. 00 [उपयोग की शर्तों का अनुपालन / Compliance with the Terms of Use]

   निम्नलिखित "नियम और शर्तें" अंग्रेजी में लिखी गई हैं। सभी उपयोगकर्ता सहमत हैं और समझते हैं कि अंग्रेजी संस्करण किसी भी अनुवादित संस्करण पर आधिकारिक "नियम और शर्तें" है।
   
   The following "Terms of Use" are written in English. All users agree and understand that the English version is the official "Terms of Use" over any translated versions.

2. 01 [समझौता / Agreement]

   उपयोगकर्ता दुकान द्वारा प्रदान की गई सेवाओं में भाग लेते समय इन "नियमों और शर्तों" का पालन करने के लिए सहमत है। किसी भी परिस्थिति में बिना समझौते के सेवाएं प्रदान नहीं की जाएंगी।
   
   Users agree to comply with these "Terms of Use" when participating in services provided by the store. Under no circumstances will services be provided without agreement.

3. 02 [उपयोगकर्ता की शर्तें / User Condition]

   उपयोगकर्ता को निम्नलिखित 4 शर्तों के अंतर्गत आना चाहिए। यदि उपयोगकर्ता किसी भी 1 शर्त के अंतर्गत आने में विफल रहता है, तो उपयोगकर्ता को सेवा का उपयोग करने की अनुमति नहीं होगी। यदि पाया जाता है कि उपयोगकर्ता सेवा का उपयोग कर रहा है भले ही उपयोगकर्ता शर्तों के अंतर्गत नहीं आता है, तो उपयोगकर्ता स्वीकार करता है कि बीमा लागू नहीं होगा।
   
   Users must meet all of the following 4 conditions. If any one of the conditions is not met, users cannot use the service. If it is found that users are using the service despite not meeting the conditions, users acknowledge that insurance will not apply.

   A) उपयोगकर्ता के पास जापान में ड्राइव करने के लिए वैध ड्राइवर का लाइसेंस या परमिट होना चाहिए (1949 जिनेवा कन्वेंशन पर आधारित अंतर्राष्ट्रीय ड्राइविंग परमिट, SOFA लाइसेंस, आदि)।
   
   A) Users must possess a valid driver's license or permit to drive in Japan (such as an International Driving Permit based on the 1949 Geneva Convention, SOFA license, etc.).

   B) उपयोगकर्ता के पास सेवा का उपयोग करने के लिए पर्याप्त ड्राइविंग कौशल होना चाहिए।
   
   B) Users must have sufficient driving skills to use the service.

   C) उपयोगकर्ता को यह समझना चाहिए कि दुकान Nintendo और/या खेल 'Mario Kart' से असंबंधित है।
   
   The User must understand that The Shop is unrelated to Nintendo and/or the game 'Mario Kart'.

4. 03 [यातायात नियमों का अनुपालन / Compliance with Traffic Laws]

   उपयोगकर्ता को सभी स्थानीय यातायात कानूनों और नियमों का पालन करना चाहिए। उपयोगकर्ता के पास जापान में ड्राइव करने के लिए वैध ड्राइविंग लाइसेंस या परमिट होना चाहिए और इसे हमेशा अपने साथ रखना चाहिए। उपयोगकर्ता के पास कार्ट चलाने के लिए पर्याप्त ड्राइविंग कौशल होना चाहिए।
   
   Users must comply with all local traffic laws and regulations. Users must possess and carry at all times a valid driver's license or permit to drive in Japan. Users must have sufficient driving skills to operate a kart.

5. 04 [कार्ट की जिम्मेदारी / Kart Responsibility]

   जापान में, कानून के द्वारा यह उपयोगकर्ता की जिम्मेदारी है कि कार्ट किसी भी ऐसी खराबी के बिना संचालित करने योग्य है जो किसी भी स्थानीय यातायात कानूनों का उल्लंघन करता है। (उदाहरण: साइड सिग्नल लाइट, हेडलाइट्स, टेललाइट्स, ब्रेक लाइट्स, ब्रेक, एक्सेलेरेशन)
   
   In Japan, it is the user's responsibility by law to ensure that the kart is roadworthy and free from malfunctions that would violate local traffic laws (e.g., side signal lights, headlights, taillights, brake lights, brakes, accelerator).

6. 05 [यातायात नियमों का उल्लंघन / Violation of Traffic Laws, etc.]

   प्रत्येक उपयोगकर्ता किसी भी यातायात उल्लंघन के लिए जिम्मेदार होगा। दुकान या टूर गाइड उल्लंघन से लगने वाले किसी भी जुर्माने या शुल्क के लिए उत्तरदायी नहीं होंगे।
   
   Each user is responsible for any traffic violations. The shop or tour guide is not responsible for fines or fees incurred due to violations.

7. 06 [अनसुलझे जुर्माने और शुल्क / Unresolved fines and fees]

   दुकान स्थानीय अधिकारियों के साथ यातायात उल्लंघन के संबंध में उपयोगकर्ता द्वारा किए गए किसी भी अनसुलझे जुर्माने या शुल्क का शुल्क ले सकती है।
   
   The shop may charge users for unresolved fines or fees incurred regarding traffic violations with local authorities.

8. 07 [यातायात दुर्घटनाएं / Traffic Accidents]

   यातायात दुर्घटना की स्थिति में, उपयोगकर्ता को टूर गाइड, स्थानीय अधिकारियों और बीमा कंपनी को सूचित करना चाहिए।
   
   In the event of a traffic accident, users must notify the tour guide, local authorities, and insurance company.

9. 08 [अनधिकृत निपटान / Unauthorized Settlement]

   यातायात दुर्घटना की स्थिति में, उपयोगकर्ता दुकान की सहमति के बिना विपक्षी पार्टी के साथ निपटान में प्रवेश न करने के लिए सहमत है। दुकान उपयोगकर्ता और विपक्षी पार्टी के बीच किसी भी असहमति निपटान समझौते के लिए उत्तरदायी नहीं होगी।
   
   In the event of a traffic accident, users agree not to agree to settlements with the other party without the shop's consent. The shop is not responsible for settlement agreements made without consent between users and other parties.

10. 09 [कार्ट बीमा / Kart Insurance]

    सभी कार्ट दुर्घटना के मामले में बीमाकृत हैं। बीमा की कवरेज सीमित और विनियमित है। दुर्घटना की स्थिति में, बीमा कंपनी घटना का मूल्यांकन करेगी। इस समय, उपयोगकर्ता को 50,000 जापानी येन का डिस्क्लेमर भुगतान करना होगा। यदि बीमा कंपनी मूल्यांकन करती है कि दुर्घटना लापरवाह ड्राइविंग का परिणाम है, तो उपयोगकर्ता को कवरेज से वंचित किया जा सकता है।
    
    All karts are insured against accidents. The insurance coverage is limited and regulated. In the event of an accident, the insurance company will evaluate the case. At this point, users must pay a deductible of 50,000 yen. If the insurance company evaluates that the accident was the result of reckless driving, users may not receive compensation.

11. 10 [कार्ट क्षति / Kart Damages]

    उपयोगकर्ता कार्ट को हुई किसी भी क्षति के लिए जिम्मेदार है। उपयोगकर्ता समझता है कि दुकान वास्तविक नुकसान के लिए शुल्क लेगी। बीमा कंपनी से जुड़ी कोई भी क्षति खंड 9 का पालन करेगी। दुकान को नुकसान के लिए दावा करने का अधिकार है।
    
    Users are responsible for any damage to the kart. Users understand that the shop will charge for actual damages. Damages involving the insurance company are subject to Article 9. The shop has the right to claim damages.

12. 11 [आपराधिक गतिविधि और संगठन / Criminal Activity and Organizations]

    उपयोगकर्ता सहमत है कि वे किसी आपराधिक संगठन के सदस्य नहीं हैं और न ही किसी आपराधिक गतिविधि में भाग ले रहे हैं।
    
    Users agree that they are not members of criminal organizations and do not participate in criminal activities.

13. 12 [कार्ट का उप-पट्टा / Subleasing Karts]

    उपयोगकर्ता किसी और को कार्ट चलाने या सवार होने की अनुमति नहीं दे सकता, जब तक कि दुकान या टूर गाइड द्वारा निर्दिष्ट न हो।
    
    Users may not allow others to drive or ride the kart unless designated by the shop or tour guide.

14. 13 [व्यावसायिक उपयोग / Commercial Use]

    कार्ट, जब किराए पर लिए जाते हैं, तो व्यावसायिक रूप से उपयोग करने की अनुमति नहीं है (कूरियर सेवा, विज्ञापन) जब तक कि दुकान द्वारा प्रदान नहीं किया जाता।
    
    Rented karts are not permitted for commercial use (delivery services, advertising) without the shop's permission.

15. 14 [मूल स्थिति में कार्ट वापस करें और पूर्ण टैंक के साथ / Return Karts in Original Status, and Full Tanks]

    टूर ग्राहकों के संबंध में, उपयोगकर्ता टूर समाप्त होने के बाद टैंक भरने के लिए उत्तरदायी नहीं होंगे। फ्रीलांस किराए के संबंध में, आवश्यक रखरखाव को छोड़कर, उपयोगकर्ता को दुकान की सहमति के बिना वाहन आदि को संशोधित नहीं करना चाहिए, जैसे स्टिकर लगाना या उपकरण स्थापित करना आदि। इसके अलावा, वाहन आदि को इसकी मूल स्थिति में वापस किया जाना चाहिए और उपयोगकर्ता को इसे वापस करने से पहले अपने ईंधन टैंक को फिर से भरना चाहिए। यदि उपयोगकर्ता पूर्ण टैंक के साथ वाहन वापस नहीं करता है, तो उन्हें दुकान द्वारा निर्धारित शुल्क का भुगतान करना चाहिए।
    
    For tour customers, users are not responsible for refueling after the tour ends. For freelance rental, except for necessary maintenance, users must not modify vehicles by applying stickers or installing devices without the shop's consent. Furthermore, vehicles must be returned in original condition, and users must fill the fuel tank before returning. If users do not return the vehicle with a full tank, they must pay the fee set by the shop.

16. 15 [अतिरिक्त समय नीति / Over Time Policy]

    टूर ग्राहकों के संबंध में, यह खंड लागू नहीं होता है। फ्रीलांस किराए के संबंध में, उपयोगकर्ता दुकान द्वारा निर्धारित स्थान और समय पर वाहन आदि वापस करने के लिए प्रतिबद्ध है। यदि उपयोगकर्ता किराए का समय पार करता है, तो उन्हें दुकान की सहमति प्राप्त करनी चाहिए और विलंब शुल्क का भुगतान करना चाहिए।
    
    This clause does not apply to tour customers. For freelance rental, users promise to return vehicles at the location and time designated by the shop. If users exceed the rental time, they must obtain the shop's consent and pay a late fee.

17. 16 [कॉपीराइट, पोर्ट्रेट और प्रचार अधिकार / Copyrights, Portrait and Publicity Rights]

    उपयोगकर्ता कार्ट और प्रदान की गई सेवाओं के उपयोग से संबंधित तस्वीरों से संबंधित कॉपीराइट, पोर्ट्रेट और प्रचार अधिकारों के लिए कोई दावा नहीं करने के लिए सहमत है।
    
    Users agree not to make any claims regarding copyrights, portrait rights, and publicity rights concerning photographs related to the use of karts and services provided.

18. 17 [क्षति और दंड के लिए दावे / Claims for Damages and Penalties]

    यदि उपयोगकर्ता इन नियमों और शर्तों का उल्लंघन करता है, तो उपयोगकर्ता नुकसान या उल्लंघन दंड के संबंध में दुकान द्वारा किए गए किसी भी दावे की भरपाई करने को स्वीकार करता है।
    
    If users violate these terms of use, users acknowledge that they will compensate for any claims made by the shop regarding damages or penalties related to violations.

19. 18 [दुकान और टूर गाइड निर्णय / Shop and Tour Guide Decision]

    उपयोगकर्ता समझता है कि दुकान और टूर गाइड को सुरक्षा जोखिमों के आधार पर एक व्यक्तिगत उपयोगकर्ता को कार्ट चलाने से निलंबित करने का अधिकार और अधिकार है (लापरवाह ड्राइविंग, टूर नियमों का पालन नहीं करना, आदि)। उपयोगकर्ता दुकान या टूर गाइड द्वारा निर्दिष्ट रूप में कार्ट वापस करेगा।
    
    Users understand that the shop and tour guide have the right and authority to stop individual users from driving karts in response to safety risks (such as reckless driving, non-compliance with tour rules). Users will return karts as designated by the shop or tour guide.

20. 19 [दुकान अस्वीकरण / Shop Disclaimer]

    दुकान उपयोगकर्ता को होने वाली किसी भी क्षति के लिए जिम्मेदार और/या उत्तरदायी नहीं होगी। दुकान को उपयोगकर्ता को प्रदान की गई सेवा को निलंबित करने, रद्द करने और बदलने का अधिकार है।
    
    The shop assumes no responsibility and/or obligation for any damages incurred by users. The shop has the right to stop, cancel, and modify services provided to users.

21. 20 [प्रेस कवरेज / Press Coverage]

    उपयोगकर्ता किसी भी मीडिया वितरण के संबंध में डेटा, जानकारी और छवियां एकत्र नहीं कर सकता। उपयोगकर्ता दुकान की अनुमति के बिना डेटा एकत्र नहीं कर सकता।
    
    Users may not collect data, information, and images in connection with media distribution. Users may not collect data without the shop's permission.

22. 21 [नियम और शर्तों में परिवर्तन / Changes to the Term and Conditions]

    उपयोगकर्ता समझता है कि नियम और शर्तें उपयोगकर्ता की सूचना या अनुमोदन के बिना अपडेट हो सकती हैं।
    
    Users understand that the terms of use may be updated without notification or approval to users.

23. 22 [समीक्षा मूल्य / Review Price]

    हम मानते हैं कि यात्रा के अनुभवों को दूसरों के साथ साझा करना और उन पर चर्चा करना यात्रा के वास्तविक आनंद में से एक है। इसलिए, मेहमानों को अपने परिवार के साथ अपने अनुभव साझा करने, उनके बारे में ब्लॉग पर लिखने, या सोशल मीडिया पर पोस्ट करने के लिए प्रोत्साहित करने के लिए, हम एक समीक्षा मूल्य कार्यक्रम प्रदान करते हैं। यह समीक्षा मूल्य तब लागू होता है जब उपयोगकर्ता अपने अनुभव को साझा करने की इच्छा व्यक्त करता है।

    We believe that sharing and discussing travel experiences with others is one of the true joys of travel. Therefore, to encourage guests to share their experiences with family, write about them on blogs, or post on social media, we offer a review price program. This review price applies when a user indicates their willingness to share their experience.
    Since cases where experiences are not shared are extremely rare, this review price is automatically applied unless user specifically decline it.
    (We do not verify whether a review was actually posted or the experience shared. The qualifying condition is simply indicating user's "willingness to share the experience.")
    However, some social media platforms, such as TripAdvisor, Google, prohibit writing reviews in exchange for discounts. Therefore, this discount does not apply on those platforms.
    If for any reason you prefer not to share your experience, please let us know. We will provide you with the regular price. And if you request it, we will keep your experience confidential.
